The Arbitration Court of Moscow considered the claim of HYDROMASHSERVICE JSC (United Trading Company of HMS Group)

The Arbitration Court of Moscow considered the claim of HYDROMASHSERVICE JSC to BELAMOS JSC and LEROY MERLIN Vostok LLC to suppress actions which violate the exclusive right to MALYSH trademark. The court found that the defendants used, without consent of the right holder, HYDROMASHSERVICE JSC, the plaintiff's trademark in selling, offering and storage for future sales of household vibration pumps with the designation Malysh. According to the judgment on case No.А40-56492/09-27-399 of September 6, 2008, the court obligated LEROY MERLIN LLC and BELAMOS LLC to stop using the name Malysh, which are similar enough to the trademark MALYSH to be confused with it, under certificate No.184623 in selling, offering and storage for future sales of household vibration pumps BV-0,12-40U5 Malysh and charge each defendant a compensation of 60,000 rubles in favor of HYDROMASHSERVICE CJSC and a state duty of 4,300 rubles.
